Terms of service – Nioomi marketplace

1. Scope of application and consent

The following general terms and conditions govern the use of the Nioomi Marketplace (hereinafter referred to as "marketplace") by consumers or users (hereinafter referred to as "user"). By using the marketplace, the user agrees to these terms and conditions.

2. Registration and access

a) Registration and creation of a user account may be required to use certain marketplace functions. Registration takes place by providing personal data, which must be truthful.

b) The user is responsible for treating their access data confidentially and not passing it on to third parties.

3. Use of the marketplace

a) The marketplace enables the user to find products or services from third-party providers and links directly to the offers of our partners.

b) The marketplace does not guarantee the accuracy of the information or the quality of the advertised products or services.

c) If a service advertised on the marketplace is used/acquired with one of our partners, the respective terms and conditions of the partners on the marketplace apply.

4. Exclusion of liability

a) The marketplace is not liable for damages incurred by the user through the use of the marketplace.

b) The marketplace is not liable for damages incurred by the user through the actions or omissions of third parties, in particular, the providers of partner programs.

5. Changes to the GTC

The marketplace reserves the right to amend these GTCs at any time. The user will be notified of changes by e-mail or by publication on the marketplace website. Continued use of the marketplace shall be deemed to constitute acceptance of the amended GTC.

6. Final Provisions

a) The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).

b) Should individual provisions of these GTCs be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.

c) The place of jurisdiction for all disputes arising from or in connection with these GTCs is

Hamburg, Germany

These GTCs shall enter into force on 31 January 2024.
